Terms of Use

These Terms of Use ("Terms") are an agreement between you ("you", "your") and Data Products LLP ("SiteMonit", "we", "us", "our"), a limited liability partnership organised in Ontario, Canada. They govern your access to and use of the SiteMonit website and service at sitemonit.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
SiteMonit lets you register URLs to monitor. We periodically fetch and render those pages, compare them to earlier captures, and notify you through the channels you configure (such as email, Telegram, Slack, Discord, webhook or Viber) when we detect a change. Check frequency, allowances and features depend on your plan.
2. Accounts
- You must provide a valid email address and keep your login credentials secure. You are responsible for activity under your account.
- You must be able to form a binding contract and use the Service in compliance with applicable law.
- You may close your account at any time from your account settings.
3. Acceptable use
You agree to monitor only pages you are lawfully permitted to access, and not to use the Service to:
- break the law, infringe others' rights, or violate a target site's binding terms or technical access controls;
- monitor at a frequency or scale intended to overload, disrupt or attack any website or service;
- collect other people's personal data unlawfully, or circumvent authentication to access content you are not entitled to;
- resell, abuse, or attempt to disrupt or reverse-engineer the Service.
You are solely responsible for the URLs you monitor and for how you use the information the Service provides. We may pause, limit or remove monitors, or suspend accounts, that we reasonably believe violate these Terms or place undue load on our systems or on third-party sites.
4. Plans, billing and cancellation
- Paid plans are billed in advance on a recurring basis (monthly or annual) through our payment processor. Prices are shown on our pricing page and may change with notice for future billing periods.
- You can cancel at any time; cancellation takes effect at the end of the current paid period, and the Service continues until then. Except where required by law, payments already made are non-refundable.
- Purchased one-time add-ons (such as extra checks) are consumed after your plan's included allowance and do not expire while your account is active.
- If a payment fails, we may notify you and, after a grace period, pause your monitors until payment is resolved. Nothing is deleted solely due to a failed payment.
5. No warranty — accuracy of change detection
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. In particular, and without limiting the foregoing:
- we do not warrant that the Service will detect every change, that every alert reflects a meaningful change, or that alerts will be timely, complete or free of false positives;
- we do not warrant that any given page can be reached, rendered or captured — many sites employ bot protection, geo-restrictions, logins or dynamic content that can prevent or distort monitoring;
- we do not warrant uninterrupted or error-free operation.
Automated web monitoring is inherently imperfect. You accept that missed changes, false or noisy alerts, delays, and capture failures can and will occur, and you agree not to rely on the Service as the sole or authoritative source for any decision that could result in loss.
6. Limitation of liability
To the fullest extent permitted by law, SiteMonit and Data Products LLP will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, opportunities or goodwill, arising out of or relating to your use of (or inability to use) the Service — including any loss caused by a missed change, a false or incorrect alert, a delayed alert, or a failure to capture a page. Our total aggregate liability for all claims relating to the Service is limited to the amount you paid us for the Service in the three (3) months before the event giving rise to the claim (or, if you use a free plan, to CAD $50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
7. Third-party sites and content
SiteMonit accesses and displays content from third-party websites that we do not control. Screenshots, text and other captured material remain the property of their respective owners; we process them only to provide the Service to you. You are responsible for ensuring your monitoring of a given site is lawful.
8. Our intellectual property
The Service, including its software, design and branding, belongs to Data Products LLP and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You keep whatever rights you already have in the URLs and settings you provide.
9. Privacy
We collect the information needed to run the Service — your account details, the URLs and settings you configure, the notification channels you connect, and captures of the pages you monitor — and use it to operate, secure and improve the Service. We do not sell your personal data. You can delete your account and associated data from your settings; some records may be retained where required for legal, security or accounting reasons.
10. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or third parties. On termination, your right to use the Service ends; sections that by their nature should survive (including Sections 5, 6, 8 and 11) will survive.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute not subject to arbitration or small-claims resolution, to the extent permitted by law.
12. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide reasonable notice. Continued use of the Service after changes take effect means you accept the updated Terms.
